How to qualify for a $13 Movie Certificate:Purchase four (4) or more participating General Mills products ("Participating Products") in a single transaction at any Smart & Final store located in California, Arizona or Nevada ("Offer") during the period beginning at 5:59 a.m. Central Time ("CT") on October 23, 2019 and ending at 11:59 p.m. CT on November 5, 2019 ("Offer Period"). Participating Products availability may vary by location; see store manager for a list of the participating items. Qualifying purchase receipt will automatically print at checkout with a 13-digit code ("Receipt Code"). Take a picture of the complete qualifying purchase paper receipt showing the Receipt Code. Submit the photo of your receipt showing the Receipt Code for validation online at www.activaterewards.com/SmartFinal by November 12, 2019. Once you have entered the required information and the receipt has been validated, you will receive a confirmation email and link to access and activate the Movie Certificate (the "Movie Certificate"), valid for one (1) admission (up to $13 total value) to see any movie in participating theaters in the US. To be eligible for this Offer, you must be at least eighteen (18) years old at the time of purchase and make a qualifying purchase of the Participating Products at any Smart & Final store in California, Arizona or Nevada. How to Activate and Receive your Movie Certificate:Qualifying purchase receipt will automatically print at checkout with a 13-digit code ("Receipt Code"). Take a picture of the complete qualifying purchase paper receipt showing the Receipt Code. The photo of the qualifying purchase paper receipt with the Receipt Code must be submitted for validation either on your mobile device or your desktop computer at www.activaterewards.com/SmartFinal no later than 11:59pm CT on November 12, 2019. In order to qualify, accurate information must be provided at registration. Once the Receipt Code is validated, you will be sent a confirmation email to the email address provided during the validation process within 2 business days and the email will contain a link to access and print the Movie Certificate that can be redeemed for one (1) admission (up to $13.00 total value) to see any movie at any participating theater in the U.S. The link in the confirmation email is void if not activated by 11:59 pm CT on January 31, 2020 and will not be replaced. Movie Certificate is void if not used within sixty (60) days from the date of activation through the confirmation email link. If cost of movie admission is more than the maximum value of the Movie Certificate, then you must pay the difference. If the cost of movie admission is less than the total value of the Movie Certificate, you will not receive the difference of such amount. Offer valid only to individual consumers. Requests from groups, clubs or organizations will not be honored. Offer cannot be transferred or combined with any other offer. If Receipt Code, confirmation email with link and/or Movie Certificate are lost or stolen, they cannot be replaced. No manual reproductions will be accepted. By participating in this Offer, you agree to be bound by these Terms and agree that Promotional Parties and Reward Provider and their designees and assigns and all of their respective officers, directors, employees, shareholders, representatives and agents ("Released Parties") shall have no liability and you agree to waive, release, indemnify, defend and hold harmless the Released Parties from and against any and all claims, liability, costs (including attorneys’ fees), losses, damages, fines or injuries (up to and including bodily injury and death) of any kind arising out of or related to: (i) your participation in the Offer; and/or (ii) any acceptance, possession, misuse or use of any Movie Certificate (including, without limitation, losses, damages or injuries to you or any other person’s equipment or other property, or to their persons). The Offer is subject to the Promotional Parties’ sole discretion and may be modified or terminated at any time without notice. The Promotional Parties are not responsible for and will not replace any lost, mutilated or stolen Receipt Codes or Movie Certificates. In the event the Promotional Parties are prevented from continuing with the Offer by any event beyond its control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Offer by any party, or any federal, state, or local government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within Promotional Parties’ control (each a "Force Majeure" event or occurrence), the Promotional Parties shall have the right to modify, suspend or terminate the Offer.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms or the rights and obligations of consumers or the Promotional Parties in connection with the Offer will be governed by and construed in accordance with the internal laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws.
BY PARTICIPATING IN THE OFFER, EACH PARTICIPANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE OFFER, OR ANY MOVIE CERTIFICATE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED ONE DOLLAR ($1.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; AND (C) UNDER NO CIRCUMSTANCES WILL ANY PARTICIPANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND PARTICIPANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED ONE DOLLAR ($1.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.
The parties each agree to finally settle all disputes only through arbitration; provided, however, the Promotional Parties shall be entitled to seek injunctive or equitable relief in the state and federal courts in Los Angeles, California and any other court with jurisdiction over the parties. In arbitration, there is no judge or jury and review is limited. The arbitrator’s decision and award is final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction. The parties agree that, except as set forth above, any claim, suit, action or proceeding arising out of or relating to this Offer shall be resolved solely by binding arbitration before a sole arbitrator under the streamlined Arbitration Rules Procedures of JAMS Inc. ("JAMS") or any successor to JAMS. In the event JAMS is unwilling or unable to set a hearing date within fourteen (14) days of the filing of a "Demand for Arbitration", then either party can elect to have the arbitration administered by the American Arbitration Association ("AAA") or any other mutually agreeable arbitration administration service. If an in-person hearing is required, then it will take place in Los Angeles, CA. The federal or state law that applies to these Terms will also apply during the arbitration. Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions; provided, however, if for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate doesn’t apply and the dispute must be brought in a court of competent jurisdiction in Los Angeles County California. The Promotional Parties agree to pay the administrative and arbitrator’s fees in order to conduct the arbitration (but specifically excluding any travel or other costs of participant to attend the arbitration hearing). Either party may, notwithstanding this provision, bring qualifying claims in small claims court.
The invalidity or unenforceability of any provision of these Terms will not affect the validity or enforceability of any other provision. In the event that any provision of the Terms is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. The Promotional Parties’ failure to enforce any term of these Terms will not constitute a waiver of that provision. Participants agree to waive any rights to claim ambiguity of these Terms. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Offer-related materials, privacy policy or terms of use on any website, social media platform or application and/or the terms and conditions of the Terms, the Terms shall prevail, govern and control and the discrepancy will be resolved in Promotional Parties’ sole and absolute discretion. CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL TO DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS OFFER IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, PROMOTIONAL PARTIES AND REWARD PROVIDER RESERVE THE RIGHT TO SEEK DAMAGES FROM SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
Offer qualification is determined when receipt image is submitted to validation site. Proof of identity and/or residence reasonably satisfactory to program administrators may be required to verify eligibility. Program administrators have the right to determine offer eligibility in their discretion; all decisions concerning offer eligibility are final. Any effort to circumvent the offer's limits, requirements or other terms (including, but not limited to, providing fictitious information or concealing identity or location) voids submissions and disqualifies person from participating in the offer.
